Retainer Agreement & Payment Policy
By engaging the services of By.LaurenSimone, L. Simone Company, LLC the Client agrees to pay a retainer fee, which serves as an upfront commitment to secure project time and services. This retainer is not a deposit for future services but a payment for reserving availability and initiating work.
• The retainer fee is required before work begins.
• It is applied toward the total project cost.
• It does not guarantee a refund if the project is canceled or abandoned by the Client.
• Any remaining balance beyond the retainer will be invoiced based on project milestones or completion.
Payment Schedule & Obligations
• Payments must be made according to the agreed schedule.
• Any outstanding balance must be paid before final project delivery.
• If additional work or revisions beyond the scope of the agreement are requested, an additional fee will be invoiced accordingly.
3. Retainer vs. Nonrefundable Deposits
• Unlike traditional nonrefundable deposits, this retainer is a payment for reserving services and time, ensuring that By.LaurenSimone, L. Simone Company, LLC is compensated for work initiated.
• Clients cannot dispute or request chargebacks for the retainer fee once paid, as it reflects work scheduled and/or commenced on their behalf.
4. Cancellation & Termination
• If the Client chooses to cancel the project after payment of the retainer, the retainer remains earned and will not be refunded.
• If additional payments have been made, any work completed up to the cancellation date will be assessed, and the Client may be responsible for additional costs if the value of completed work exceeds the retainer amount.
Dispute Resolution
• By making a payment, the Client agrees that all fees paid are final and non-disputable under the terms of this agreement.
• Any concerns regarding services should be communicated promptly to resolve any issues amicably before initiating disputes through financial institutions.
